Rights are meaningful only when they can be implemented, treated. Our Constitution only guarantees certain rights but also gives the right to knock the doors of the judiciary of the country on their violation.
The fundamental rights of the citizens come under the jurisdiction of the entire jurisdiction of the judiciary. According to Article 32, the Supreme Court can issue various writs for the treatment of privileges.
Such as (1) Habeas Corpus, (2) Permit, (3) Inducement, (4) Prohibition, (5) Rights Quo.
A similar writ Under 226 the High Court can also issue.
On the violation of fundamental rights, any person can go to the Supreme Court without an appellate process and a court order, along with instructions, can also issue the aforesaid rites. On the basis of public interest litigation, any member of the public can file a petition on behalf of the aggrieved party.
The right of inclusion in the court is guaranteed by the appropriate proceedings to enforce the rights.
Thus the judiciary is the watchdog/protector of both the constitution and fundamental rights.
