President and Prime Minister's rule in India has two important parts. Theoretically where all executive power lies in the President.
At the same time, the real power is vested in the Council of Ministers including the Prime Minister. Therefore, the relationship between the President and the Prime Minister is as follows:
(1) Section Under 74, there will be a Council of Ministers to assist and advise the President, who will be the Prime Minister and Anu. The Prime Minister appoints the leader of the party with a majority under 75 (in the Lok Sabha).
(2) The Prime Minister is the bridge between the President and the Council of Ministers. Anu. 78 Legislation makes all prime decisions regarding the administration and legislation of the Union to be communicated to the President.
(3) The Prime Minister advises the President in the appointment of various officials such as the Comptroller and Auditor General, Comptroller and Auditor General, Chairman of the Union Public Service Commission, Governor and Ministers.
(4) The Prime Minister advises the President-
(i) allocation and reshuffle of departments between ministers, (ii) dismissal of any minister,
(iii) With regard to convening and prorogating the Parliament session,
(iv) to dissolve the Lok Sabha;
(v) The 44th Constitutional Amendment provides that the President can return the advice of the Cabinet for deliberation and thereafter it is binding on him to accept the advice.
(vi) The President also declares the Emergency on written advice of the Prime Minister's Cabinet.
In this way, the President and Prime Minister are the directors and sailors of the ship of the Raj respectively, one is the ceremonial head and the other is the real head.
